Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Chatterbox (the “Service”), operated by Cybersapien Technologies (“Chatterbox”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of terms

By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a business, you represent that you are authorised to bind that business to these Terms.

2. Description of the Service

Chatterbox provides an AI-powered chat widget and admin dashboard for small businesses. The widget answers your site visitors from your own connected content and helps you capture leads. Features, limits, and plans may change as we improve the Service.

3. Accounts & eligibility

You must provide accurate information, keep your account credentials secure, and are responsible for activity under your account. You must be capable of forming a binding contract to use the Service. You are responsible for your team members’ use of your account.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or deceptive purposes.
• Upload or connect content you don’t have the right to use, or that infringes others’ rights.
• Attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the Service.
• Use the Service to collect data without a lawful basis or to send spam.
• Misrepresent the AI’s output as professional advice.

5. Plans & billing

We offer a Free plan and paid monthly plans (Starter and Pro) priced in Indian Rupees (₹). Paid plans renew monthly until cancelled. Every plan is capped, so usage beyond your plan’s limits pauses rather than generating surprise charges. No card is required to start on Free. You can cancel anytime with no lock-in; cancellation takes effect at the end of the current billing cycle. Prices and plan limits may change on reasonable notice. 6. Your content & responsibilities

You retain ownership of the content you connect, upload, or that flows through your widget (including your website content, chat transcripts, and captured leads). You grant Chatterbox a limited, worldwide licence to host, process, and transmit that content solely to operate and provide the Service to you (including sending relevant text to AI providers to generate answers). You are responsible for your content, for having the rights and notices/consents needed to process your visitors’ data, and for complying with applicable law as the data controller for your visitors.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by Chatterbox and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any of our intellectual property to you.

8. AI output & disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. AI-generated answers are based on your connected content but may be incomplete or inaccurate; you are responsible for reviewing them and they are not professional, legal, financial, or medical advice. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Chatterbox will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the three months preceding the claim.

10. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive (such as IP, disclaimers, and liability) will survive.

11. Changes to these terms

We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date and provide notice where appropriate. Your continued use after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of India, and the courts at Chandigarh, India will have jurisdiction, without regard to conflict-of-laws principles.
